1. About Volcastay

Volcastay® is a registered trademark and travel platform operated by its proprietor.

Volcastay® is a technology platform and booking facilitator connecting guests, hosts, travel partners, transport providers, event organizers and activity providers. Volcastay may facilitate discovery, communication, booking requests, payment collection and related services. Volcastay is not the owner, operator, manager, controller or insurer of every listed property, transport service, event, expedition, adventure activity or third-party service available through the platform.

2. Electronic Consent

By accessing, registering or transacting on Volcastay®, you electronically consent to these Terms, the Privacy Policy, and all related policies under the Information Technology Act, 2000 and applicable Indian law. Continued use constitutes acceptance of the then-current version.

3. Eligibility

You must be 18 years or older and legally competent to contract. Accounts may be verified, suspended or terminated at Volcastay's sole discretion.

4. Bookings & Payment

All bookings require full advance payment unless expressly agreed in writing. Confirmation is subject to host acceptance, identity verification and successful payment realization. Volcastay® acts solely as a booking facilitator and payment collector on behalf of hosts and third-party providers.

5. Cancellations & Refunds

Cancellations and refunds are governed by the Cancellation & Refund Policy, which forms an integral part of these Terms.

6. Disclaimer of Warranties

The platform and all services are provided on an "as is" and "as available" basis. Volcastay® disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability and safety of any property, vehicle, activity or third-party service.

7. Limitation of Liability

To the maximum extent permitted by law, Volcastay's aggregate liability for any claim arising out of or relating to the platform or any booking shall not exceed the platform-service fees actually retained by Volcastay® from the specific booking giving rise to the claim. Volcastay® shall not be liable for indirect, incidental, consequential, exemplary, punitive or special damages, loss of profit, loss of data, personal injury, death, property damage or third-party acts.

8. User Assumption of Risk

Travel, stays, transport, pet travel, adventure and expedition activities carry inherent risks. You voluntarily assume all such risks for yourself, your companions, your pets and your property.

9. Indemnification

You agree to defend, indemnify and hold harmless Volcastay®, its proprietor, employees, agents and affiliates from any claim, loss, liability, damage, cost or expense (including reasonable legal fees) arising from your use of the platform, your breach of these Terms, your content, your conduct, your pets, or any booking you make.

10. Platform Rights

Volcastay® may, without notice and at its sole discretion, suspend or terminate accounts, remove listings, remove reviews, refuse service, investigate suspected fraud, require identity or KYC documentation, hold or reverse payouts, and cancel suspicious bookings.

11. Chargeback Protection

Initiating a chargeback in violation of these Terms or the Cancellation Policy is a material breach. Volcastay® reserves the right to dispute such chargebacks, recover associated fees, blacklist the user and pursue all available legal remedies.

12. Force Majeure

Volcastay® shall not be liable for any failure or delay caused by events beyond its reasonable control including acts of God, weather, natural disasters, pandemics, epidemics, government action, civil unrest, strikes, war, terrorism, network or infrastructure failure.

13. Third-Party Providers

Hosts, transport providers, event organizers, guides, activity providers and partners are independent contractors. No employment, agency, partnership or joint venture is created with Volcastay®. Liability for their acts or omissions rests solely with them.

14. Intellectual Property

Volcastay®, the Volca Stay logo, and all associated marks, content, software, designs and compilations are owned by the proprietor and protected under Indian and international IP law. No use is permitted without prior written consent.

15. Modifications

Volcastay® may amend these Terms at any time. The updated version becomes effective upon posting. Continued use constitutes acceptance.

16. Dispute Resolution

Any dispute arising out of or in connection with these terms shall first be attempted to be resolved through good-faith negotiation between the parties. If unresolved within thirty (30) days, the dispute shall be referred to arbitration before litigation wherever legally permissible, conducted by a sole arbitrator appointed by Volcastay®, governed by the Arbitration and Conciliation Act, 1996, with the seat and venue at SAS Nagar (Mohali), Punjab, India, in the English language. Subject to arbitration, the courts at SAS Nagar (Mohali), Punjab, India shall have exclusive jurisdiction.
