1. Host Status
Hosts are independent operators of their properties. Volcastay® is a booking facilitator only and is not the lessor, operator, manager or insurer of the property.
2. Property Responsibility
Hosts are solely responsible for property condition, cleanliness, safety, structural integrity, electrical and gas safety, fire safety, food safety and accurate listing information.
3. Licences & Compliance
Hosts must hold and maintain all required licences, registrations, permits, tax registrations (including GST where applicable), municipal approvals, society NOCs, and comply with all applicable local, state and central laws.
4. Guest Safety
Hosts are responsible for guest safety on the property, including secure premises, working safety equipment, emergency contacts and adequate insurance.
5. Indemnity
Hosts shall defend, indemnify and hold harmless Volcastay® from any claim, loss, damage, fine, penalty, tax demand or legal proceeding arising from the property, the listing, host conduct, guest interactions, third-party claims, regulatory non-compliance or breach of these terms.
6. Pricing & Payouts
Hosts authorise Volcastay® to collect guest payments on their behalf and remit net payouts after platform fees, taxes and applicable deductions, on the agreed schedule. Volcastay® may withhold payouts where fraud, chargeback or disputes are reasonably suspected.
7. Cancellations by Host
Host-initiated cancellations are strongly discouraged and may attract penalties, relocation costs, listing suspension and recovery of any loss caused to guests and to Volcastay®.
8. Reviews & Content
Hosts grant Volcastay® a perpetual, royalty-free licence to use property photos, descriptions and reviews for the platform's operation and promotion.
9. Suspension & Removal
Volcastay® may suspend, demote or remove any listing at its sole discretion, including for safety, legal, brand, fraud or quality reasons.
10. Independent Contractor
Nothing in these terms creates employment, agency, partnership or joint venture between Volcastay® and the host.
11. Dispute Resolution
Any dispute arising out of or in connection with these terms shall first be attempted to be resolved through good-faith negotiation between the parties. If unresolved within thirty (30) days, the dispute shall be referred to arbitration before litigation wherever legally permissible, conducted by a sole arbitrator appointed by Volcastay®, governed by the Arbitration and Conciliation Act, 1996, with the seat and venue at SAS Nagar (Mohali), Punjab, India, in the English language.
